1. General

Translation

Our German General Terms and Conditions apply to all business transactions between the agency, the ski instructors | ski guides | mountain guides to be placed, and the customers. Translation into other languages is a service of the agency and has no legal claim.

General Terms Of Conditions Information

Fun&Snow is an agency that arranges independent, licensed ski instructors | ski guides | mountain guides to the guests of the Arlberg region. It is up to each mediated ski instructor | ski guide | mountain guide whether they participate in the common appearance, with the same corporate design, corporate identity and external appearance, or to find their own design. It is not a prerequisite to be placed through the agency. In every sense, each member remains independent and economically autonomous from this agency. Only the contact to the guests is mediated.

The agency ensures that every ski instructor | ski guide | mountain guide has the necessary training, licence, liability and legal insurance protection. When selecting the ski instructors | ski guides | mountain guides to be placed, great importance is attached to the fact that, in the interests of safety, instruction is given and guided in the back country and that generally accepted standards are observed. The agency is in no way authorized to give instructions to the mediated ski instructors | ski guides | mountain guides.

The brokered ski instructors | ski guides | mountain guides offer services such as  ski courses and ski guiding. Ski courses include learning, applying and perfecting skiing techniques on the piste, ski race training, demo and formation training, steep slope, mogul slope and terrain training, freestyle and freeride lessons. Not only skiing is taught, but also snowboarding, cross-country skiing and telemark skiing in the above mentioned areas. Ski guiding includes guiding our guests in back country areas, on ski tours and heliskiing. They are instructed by them using the necessary safety measures and point out dangers and risks.

The ski instructors | ski guides | mountain guides brokered through us have all the highest training in these specialist areas and are state certified.

2. Construction of service contract

Reservations can be made by email or by phone at the agency. After receiving the request, possible ski instructors | ski guides | mountain guides will be informed. Ski instructors | ski guides | mountain guides who would like to take over this request then contact the agency. The ski instructor | ski guide | mountain guide who will take over the request is determined by a ranking. They will contact the guest, clarify all further details and fix the reservation.

Reservations are only valid after receipt of the full name, address, credit card information, which serves as security for any cancellation fees due, and after written confirmation by the ski instructor | ski guide | mountain guide. The service contract is concluded with the ski instructor | ski instructor | mountain guide prior to the start of the service and not with the agency.

3. Fulfilment of contract

The assessment of our guests’ abilities to carry out the course requested by the guest is the responsibility of the ski instructor | ski guide | mountain guide. If the skills and requirements are not sufficient, alternative suggestions will be given to provide the guest with the necessary prerequisites to continue the course at the desired location at a later date when all requirements have been met.

When the requirements are sufficient for the desired course, booking is the responsibility of the ski instructor | ski guide | mountain guide.

The wishes of the guest are respected by the ski instructors | ski guides | mountain guides and are carried out within the framework of the guest’s safety. Should safety not be guaranteed, the ski instructor | ski instructor | mountain guide can offer alternatives. Reasons for the lack of safety may include, but not be limited to, weather conditions, dangers in the terrain, danger of avalanches and insufficient or missing equipment (Avalanche beacon, probe, shovel). The ski instructor | ski guide | mountain guide decides which safety points are to be taken into consideration and informs the guest about which points and which reasons may jeopardise safety.

In any case, the guest is not entitled to withdraw from the contract for the above-mentioned reasons and demand reimbursement of the course costs. The safety of our guests is our top priority and has priority for the ski instructors | ski guides | mountain guides we have arranged.

4. Price

The agency only passes on price orientations to the guests in the run-up to inquiries. No prices are determined by the agency. The prices quoted are the average of the price range in which most ski instructors | ski guides | mountain guides operate.

The prices for the services are set by the ski instructor | ski guide | mountain guide to be hired. They are not bound by any price specifications set by the agency.

All prices quoted are in the national currency of the agency’s headquarters, including the statutory VAT.

The price only includes the ski instructor | ski guide | mountain guide activity. Fixed daily prices for classic ski instruction include approx. 4 hours. For bookings of the mediated ski instructors | ski guides | mountain guides as ski guides, the fixed daily rates, depending on the external conditions and the physical abilities of the guest, include a day tour, which usually lasts about 4.5 hours. However, the decision on the current length is up to the ski instructor | ski guide | mountain guide.

The price does not include the lift ticket, helicopter flights, ski and safety equipment. They can be organised by the ski instructor | ski guide | mountain guide, but must be paid separately.

5. Terms of payment

For bookings made more than one month in advance, 30% of the invoice amount must be transferred as a deposit to the account of the ski instructor | ski guide | mountain guide immediately after the written confirmation. The final settlement will be made at the end of the services, or in the case of cancellations, as soon as the cancellation deadlines set out in the GTC’s have been exceeded. The invoice amount can be paid in cash, by credit card or by bank transfer. In case of cancellation, the outstanding amount can be debited from the credit card by the brokered ski instructor | ski guide | mountain guide, if the guest is not willing to pay the invoice.

6. Liability regulations

In principle, the brokered ski instructor | ski guide | mountain guide is liable according to legal regulations. A corresponding liability insurance exists. For all activities the participants are not insured in the event of accidents. An appropriate accident insurance is recommended, but is the responsibility of the guest.

The sole purpose of the agency is to find the right ski instructor | ski guide | mountain guide for the guest. After mediation, the guide is responsible for all further tasks concerning the service.

The agency does not accept any liability for the actions of the ski instructors | ski guides | mountain guides and the consequences, injuries and damages arising from them. Nor can any liability be transferred to other ski instructors | ski guides | mountain guides to be procured. Only the respective ski instructor | ski guide | mountain guide with whom the contract was concluded can be held liable for his actions.

7. Cancellation

Cancellations up to 14 days before the first day of skiing are free of charge. Cancellations within the last 14 days before the first day of skiing up to 7 days before the first day of skiing are charged 30% of the total price. For later cancellations, within the last 7 days before the first day of skiing until 12:00 noon the day before, 60% of the total price will be charged. From 12:00 noon the day before the first day of skiing, 100% of the total price will be charged.

Short-term bookings up to five days before the first day of skiing can be cancelled until 12:00 noon on the day before, after which 100% of the total price will be charged.

In case of cancellation during a running service or if you do not show up at the agreed date, the total price will be charged. Bad weather conditions are not a reason for cancellation.

For a cancellation due to accident or illness, we recommend a travel cancellation insurance, which covers the cancellation fees incurred.

8. Court of Jurisdiction

The court at the agency’s headquarters shall have exclusive jurisdiction to decide all disputes arising from this contract.

9. Legal rights

Austrian law applies to all services provided.

10. Legal validity

Should individual provisions of these terms and conditions of business be invalid, this shall not affect the validity of the remaining provisions and the validity of the entire legal transaction. The invalid provision shall be replaced by a provision which comes closest to the invalid provision in economic terms.
